GENERAL TERMS & CONDITIONS

In this text, “you” is to be interpreted as the client who has made the booking and all participants the client is bringing with him in his group. The “guide” denotes a certified mountain guide or a certified hiking guide.
Any booking means you have read, understood and accepted those General Terms and Conditions.
I reserve the right to change, modify or otherwise alter these terms at its sole discretion at any time.

1 - Physical prerequisites: an average physical condition is required for all trips.
It is the responsibility of the client to be aware of the fitness level for a particular trip. When in doubt, please call and discuss it with the guide.
The client must inform the guide of medical conditions, illnesses or disorders that may be relevant for safety reasons or aggravated during the tour.
Please consider the suitability of such an event/activity before booking.

2 - Equipment: every participant is required to bring the equipment listed by the guide.
The guide will ensure that all participants have all the necessary equipment or clothing and reserve the right to exclude participants who don't have the minimum equipment required.
The customer is responsible for all equipment issued for use during the tour. The guide reserves the right to charge for equipment that is lost or misused.

3 - Liability: the guide always tries to lead as safe as possible and conform to all possible situations during the tour. Nevertheless objective danger can occur any time, therefore no absolute safety can be assured!

Mountain tours, of whatever nature, generally entail significant physical strain and risks which may result in injury or even death; the client is aware of that and is willing to run such risks when concluding an agreement on a tour.
Except in respect of death or personal injury caused by the negligence of the guide, none of the guides will be made liable for:
- illness, injury, death, loss, theft or damage of personal effects, cash, objects of value, photo equipment during the duration of a tour

- failure by you to take out adequate insurance

- Fault on your part before and during to the trip

- Act of a higher power or on an event which the guide could not foresee or prevent in spite of all possible caution, in particular natural disasters and official government actions

All bookings are made on the basis that you will strictly observe the safety instructions given by the guide. If you choose to ignore the advice of the guide you do so at your own risk and forfeit a duty of care from the guide.

4 - Exclusion of participation: the guide is permitted not to allow you to join an activity, or to exclude you from one, if you do not meet the personal participation requirements, your participation would endanger you, other clients or the guide or in any other way make the activity impossible in the long-term. This applies accordingly to a participant you have referred.
No refund will be made to participants excluded on these safety grounds.

5 - Program change: the guide reserves the right to change the mountain objective, itinerary or stop the tour should he believe that continuing would place any group member and/or himself at undue risk due to unfavorable weather conditions and/or participant ability.
For stopped or changed tours, the whole amount for the primary planned tour will be charged.

6 - No shows: you are responsible for arriving on time at the notified meeting point. All public hiking tours run on "Austrian time". This means that we leave promptly at the published departure time. If you are late, the tour will leave without you and your reservation will be forfeited without refund. Please make your greatest effort to show up on time.

7 - Public tours involve joining with other guests towards a common mountain tour and sharing the cost of guiding fees. These can be fun & sociable trips and we try hard to ensure all members of the team are suited to the courses they are undertaking. However, occasionally guests will struggle from unforeseen circumstances and will have to turn around during a tour. By booking on one of my public tours you are joining a team and must accept this may compromise your own mountain goal or other aims. Folk not wanting to accept this compromise should book private guiding.

8 - Booking:

1/ Call or e-mail me to inquire about my availability. Once I have accepted your request for guiding service, you will be asked to pay a deposit. An email with bank or PayPal details will be sent to you for this.

2/ Pay the deposit. Booking is not finalized until the deposit is paid! Once the payment is received, the cancellation policy is in effect and it is implied and accepted that you have read and understood all the booking information and conditions and agree to abide by them.

The remaining balance is due to the guide at the meeting location.
The guide is not responsible for any incidental expenses the client may have incurred in reliance on the tour including, without limitation, expenses arising from the purchase of visas, vaccinations, non-refundable flights, or of any loss of enjoyment.
All prices quoted on the website are subject to change without notice.

9 - Cancellation:

• By the guide: the guide reserves the right to cancel any trip because of causes that make it infeasible for the scheduling of the trip (conditions on the mountain, illness, injury or insufficient number of participants). If this is the case, you will be informed within 24 hours prior to trip start date. In the event of this occurring, you will be offered an alternative or full refund of the deposit but I take no responsibility for any other fees that the client has incurred like flights, hotels or any other expenses relating to the trip out with my guiding fee.

• By the client: if you wish to cancel your trip, this must be done by email or sms. The following conditions will apply, according to when you inform the guide:
Day tours (public & private):
- Until 5 days prior to the tour: you receive a full refund of deposit
- Within 5 days prior to the tour: loss of 100% of deposit

Multi-days or private tours:
- More than 30 days before trip start date: you receive a full refund of deposit
- 4 to 1 week before trip start date: loss of 50% of deposit
- Less than 8 days before trip start date: loss of 100% of deposit

• During a tour: once a tour begins, no refund will be given. If a tour has been started and cannot be completed (because of bad weather conditions, weak physical condition of the group by example), the guide must be paid. Payments are not refundable based on itinerary changes.

10 - Self-responsibility for mountain rescue insurance: in Austria, you will always be asked to pay for mountain rescue and this could be several thousand euros, especially if helicopters are involved.
The settlement of a valid accident and health policy (with stipulations of mountain rescue coverage) covering any medical and/ or related costs (e.g. helicopter off the track, hospital care, etc.) is strongly recommended.
Insurance coverage is the responsibility of the client.
The price of guiding service and intermediary service does not include insurance.
Trekking Austria or the guides accept no responsibility for costs incurred.

11 - Right of image: the guide may seek to use photos of participants for the website/publicity purposes without obtaining any further consent or payment in respect of such photographs and/or films. Please advise the guide before the tour if you would prefer not to be involved in this.

12 - Court of competency and responsibility: the exclusive place of jurisdiction is Vienna, Austria.

Trekking Austria as intermediary - Additional Terms & Conditions

In case I can't guide myself a tour, I can connect you with other guides and enable you to conclude booking transactions with them.
In this case, I (=Trekking Austria) act as an intermediary between clients and guides. The focus is on helping to find and arrange a mountain guide for your mountain activity.
Additional Terms & Conditions complement the General Terms and Conditions above.
Any booking with Trekking Austria as intermediary means you have read, understood and accepted those Additional Terms and Conditions.

1 – Liability: the guides are not employees, agents or representatives of Trekking Austria, but entrepreneurs who act independently and on their own account.
The legal contract for the supply of guiding activities and the corresponding booking transactions is between the guide and the client. Any agreement relating to a tour is formed only between the client and the guide.

Trekking Austria is not responsible for any arrangements made between the client and the guide. Only the guide, and not Trekking Austria in any way, shape or form, is responsible for preparing and holding the tour properly.
Trekking Austria does not control the timing and quality of the guiding service actually delivered by the guide nor of the integrity, responsibility or any of the actions whatsoever of the guide.

Trekking Austria does not appear itself as the organizer, lessor, seller or other contract partner with regards to the guiding service agreement with the client.Therefore Trekking Austria assumes no liabilities for harms or conflicts with second or third party. Regarding potential contestation please always contact your personal guide.

2 - Booking: the registration should be done as early as possible. According to the availability of the guides the registration will be accepted or not.

1/ Call or e-mail Trekking Austria to inquire about availability of a guide. Once a guide has accepted your request for service, you will be asked to pay the intermediary commission. An email with bank or PayPal details will be sent to you for this.

2/ Pay the intermediary fee to Trekking Austria. Booking is not finalized until it is paid! Once the payment is received, the cancellation policy is in effect and it is implied and accepted that you have read and understood all the booking information and conditions and agree to abide by them.

Once the guide has accepted client’s request for guiding service and the payment of the intermediary fee has been processed to Trekking Austria, there is a binding contract between the client and the guide.
The customer will be notified by the guide himself of the payment method and terms for the respective guiding service.
Trekking Austria does not collect the invoiced amounts in the name of and on behalf of any guide.
The guide and Trekking Austria are not responsible for any incidental expenses the client may have incurred in reliance on the tour including, without limitation, expenses arising from the purchase of visas, vaccinations, non-refundable flights, or of any loss of enjoyment.

3 - Cancellation:

- More than 30 days before trip start date: you receive a full refund of the intermediary fee
- 4 to 1 week before trip start date: loss of 50% of intermediary fee
- Less than 8 days before trip start date: loss of 100% of intermediary fee

• During a tour: once a tour begins, no refund will be given. If a tour has been started and cannot be completed (because of bad weather conditions, weak physical condition of the group by example), the full amount agreed for the guiding service must be paid to the guide. Payments are not refundable based on itinerary changes.
Additional costs for accommodation, food and transport can be in addition to the guiding service price. Trekking Austria is not responsible for administering any requests or claims related to or arising from any charges or payments between the guide and the client. Trekking Austria disclaims any liability in this respect.
Trekking Austria is not liable for defects in the performance of the service and personal or material damage incurred by the client in connection with the guiding service provided.

4 - Release indemnity: you agree that any legal action, remedy or liability that you seek to obtain for actions or omissions of the guide will be limited to a claim against the guide or other third parties who caused you harm at the exclusion of Trekking Austria to the fullest extent permitted by applicable law.
