Terms & conditions

Registration and Payment

Registration signifies and binds the participant to acceptance and responsibility of those general terms and conditions.

Multi-days and customized (for private groups) trip:
• I encourage you to book as early as possible. To book a place on a trip, please call or e-mail me to inquire about availability. An email will be sent to you to confirm the booking.
• Payment: please pay the deposit before the date agreed. Please pay your deposit straight away after I have confirmed the booking, as I can only hold unconfirmed places for a limited time. Outstanding amount to be paid in cash at day of departure.

One day trip:
• Bookings need to be made at least 48 hours in advance. To book a place on a trip, please call or e-mail me to inquire about availability. An email will be sent to you to confirm the booking.
• Payment: in cash at the meeting point.

Note: all prices quoted on the website are subject to change without notice.

Liability

Difficulty/prerequisites: average physical conditioning but no previous mountaineering experience is required.
It is the responsibility of each participant to be aware of the fitness level for a particular trip. When in doubt, please call and discuss them with me! The participants must inform me of any medical condition that's requires attention or medication before the tour commences.

All bookings are made on the basis that the participant will strictly observe the safety instructions given by the guide. I reserve the right to exclude at any time participants from tours they are not fit enough for and where their involvement may jeopardise their own, other participants or the guide safety. No refund will be made to participants excluded on these safety grounds.

I am not responsible for non-performance and faulty performance of the contract in the following cases:
• Fault on your part before and during to the trip.
• For unforeseeable or unavoidable fault of a third party who is not involved in the performance of services as agreed upon in the contract.
• Act of a higher power or on an event which we could not foresee or prevent in spite of all possible caution, in particular natural disasters and official government actions.
• Loss, theft or damage of personal effects, cash, objects of value, photo equipment during the duration of a tour

Changes: changes to the itinerary are at the discretion of the guide. These changes may be made due to weather conditions, conditions on the mountains, changes in accommodation, or fitness of the group.

Cancellation

• Before a tour:

One day trip:
- By me: I reserve the right to cancel any trip because of causes that make it infeasible for the scheduling of the trip (conditions on the mountain, illness, injury or insufficient bookings. If this is the case, I will inform you within 24 hours prior to trip start date. I am not responsible for additional expenses incurred by preparing for the trip.
- By you: if you wish to cancel your trip, this must be done 48 hours prior to day tour by email, phone or sms.

Multi-days and private trip:
- By me: I reserve the right to cancel any trip because of causes that make it infeasible for the scheduling of the trip (conditions on the mountain, illness, injury or insufficient bookings. If this is the case, I will inform you within 10 days prior to trip start date. You receive a full refund of deposit. I am not responsible for additional expenses incurred by preparing for the trip.
- By you: if you wish to cancel your trip, this must be done by email or sms. The following conditions will apply, according to when you inform me:
   • More than 30 days before trip start date: you receive a full refund of deposit
   • 4 – 1 week before trip start date: loss of 50% of deposit
   • Less than 8 days before trip start date: loss of 100% of deposit

• During a tour: once a tour begins, no refund will be given. If a tour has been started and cannot be completed (because of bad weather, physical condition of the group y example), I must be paid according to the duration of the tour. Payments are not refundable based on itinerary changes.

Mountain rescue insurance

Insurance coverage is the responsibility of the participant. The settlement of a valid accident and health policy (with stipulations of mountain rescue coverage) covering any medical and/ or related costs (eg helicopter off the track, hospital care, etc.) is vital.
In Austria you will always be asked to pay for mountain rescue and this could be several thousand euros, especially if helicopters are involved.
It is your responibility to verify that you are covered. I accept no responsibility for costs incurred.

Right of image

I may seek to use photos of participants for the website/publicity purposes without obtaining any further consent or payment in respect of such photographs and/or films. Please advise me before the tour if you would prefer not to be involved in this.

Court of Competency and Responsibility

The Austrian courts of justice are responsible without exception and will preside over the proceedings of any legal complaints, regardless of the nationality of the parties involved or where the accident or damage occurs. The court of responsibility and competency is in Vienna, Austria.
